Framingham - Unlicensed Operation - Complaint Application Denied

Our client was given a motor vehicle citation for unlicensed operation of a motor vehicle, and operating an unregistered motor vehicle. Our client had faced similar charges of unlicensed operation a number of time before. Our client requested and was afforded a Clerk Magistrate's hearing to determine if a criminal complaint should issue.

Attorney Alexander Conley represented our client at the Clerk's hearing. Based on Attorney Conley's arguments, the clerk decided to deny the complaint application, and thus preserve our client's criminal record, upon the payment of fees.

An attorney is not required at Clerk's hearing, but sometimes they can craft the best arguments to avoid the issuance of a criminal complaint. Once a complaint is issued and a person is arraigned in front of a judge, the charge becomes part of their criminal record.
