Framingham - Unlicensed Operation - Complaint Application Denied

Our client, who is unable to apply for a driver's license due to immigration issues, was pulled over while driving home. Our client was stopped after driving in the wrong lane of traffic. Upon the stop, our client admitted to not being licensed. Our client was given a citation for the criminal offense of unlicensed operation of a motor vehicle. Our client had been charged with this offense once prior.

Our client was advised to sign the back of the citation, take it to the Framingham District Court, and request a clerk magistrate's hearing. This was done, and a hearing was scheduled. At this kind of hearing, a clerk magistrates decides whether to approve an application for a complaint, and thus issue a criminal charge, or to deny the application for lack of probable cause, or for other reasons in the clerk's discretion.

Attorney Alexander Conley represented our client at the clerk magistrate's hearing. The evidence against our client was given to the clerk. After Attorney Conley spoke on behalf of our client, the Clerk agreed to deny the application for the complaint on the mere payment of fees. The clerk was impressed with the fact that our client took the matter seriously and hired an attorney for representation.

Because the complaint was not issued, there will be no entry on our client's criminal record that could affect future employment, housing, or immigration opportunities. Sometimes the presence of an attorney who knows what to do can make a big difference in the outcome of a case. That is why it is important to contact a criminal defense attorney, like the attorneys at Aprodu | Conley, even for minor motor vehicle infraction, so that they can help you follow the necessary steps to work toward the best resolution of your case.
